This type of coverage is a combination of what are commonly known in the traditional insurance industry as Errors and Omissions and Directors and Officers coverage. However, because we cover more school divisions in the Commonwealth than any other provider, we tailor our coverage to meet the specific needs of our members. We include coverage for defense costs related to certain excluded wrongful acts, including fraud and dishonesty, profit and gain, violation of statute, employee benefit plans, breach of fiduciary duty, breach of contract, the Asbestos Hazard Emergency Response Act, and land use/eminent domain. We even provide defense coverage for administrative complaints from the Office for Civil Rights (OCR) and the Equal Employment Opportunity Commission (EEOC) before they become lawsuits.
